Every woman has the right to abortion - Supreme Court of India
We have already mentioned on our website and in a couple of blog articles (given below) that every woman who is legally an adult has the right to abortion until 24 weeks of pregnancy and doesn’t need consent of anyone else as per the Medical Termination of Pregnancy Amendment 2021. In case of minors, a parent or a guardian needs to be present.
Someone or a group filed a plea in the supreme court requesting clarity on the MTP Amendment Act 2021 saying that the law didn’t include single women. Then, the apex court of India, on 29th September 2022 said that all women, including those not married could get an abortion up to 24 weeks. “If you take a careful look at the amended act, it never mentions anything about marriage or married women. So, I personally wonder, what made them file a plea in the apex court” says Dr. Deepa Ganesh, one of the popular female cosmetic gynaecologists in Chennai.
